Famipics

Terms of Service

These terms are the agreement between you and JUJUTECH for the use of Famipics, the app and the website at famipics.com. By creating an account or joining a family you accept them. Please read them; section 5 in particular describes something no other photo service asks you to know.

1. The operator

Famipics is provided by JUJUTECH, a sole proprietorship registered in Japan ("we"). Contact: support@famipics.com. Details required by the Act on Specified Commercial Transactions are on the legal notice page.

2. What Famipics is

Famipics lets a family keep photos and videos in a shared album that only its members can open. A family is created by one person, its owner, who invites the others; every member sees the album on their own phone, and can add photos, comments and reactions according to their role. The album is free within the limits of the free plan; the paid plan has no limit on the number of photos or on the total duration of video, within the fair use of section 7 (section 6). There is no advertising, on any plan.

3. Who may use it

You must be at least 18 years old, or use Famipics with the consent of a parent or guardian who accepts these terms on your behalf. You sign in with an Apple or Google account that is yours; you are responsible for keeping that account, and the phones you use Famipics on, under your control.

4. Your content

What you add to an album stays yours. Because it is locked on your phone before it reaches us (section 5), we never obtain access to it, and the only permission you give us is the technical one: to store the locked files and pass them to the other members of the family, on your instruction. We claim no other right over your photos, videos or words.

You agree to add only content that:

An album belongs to its family. A photo you add can be seen by the family's members for as long as the family keeps it, including after you leave; a photo can be deleted by the member who added it or by the family's administrators.

5. Your keys, and what we cannot do

Famipics locks everything in an album with keys held only on the family's phones. This is the whole point of the service, and it has a consequence you must accept:

The free plan's limits, the paid plan's price and the length a single video may have are described in the app and on the legal notice page. The free plan's limits are counts of photos and minutes of video held in the album, not monthly allowances; the paid plan has no limit on either, and its use is governed by section 7.

7. Fair use

Unlimited, on the paid plan, means no limit on the number of photos or on the total duration of video in the album — the length of a single video is limited separately — and it is meant for one family keeping its own album, within ordinary family use. The following uses go beyond that, and we may limit the adding of new photos and videos by a family that uses Famipics in one of these ways:

You may stop at any time: leave a family, delete a family you own, or delete your account from the settings screen. Deleting your account disconnects your phones and ends your memberships; it does not cancel a store subscription (section 6). Suspension and closure of an account by us are set out in section 10.

We may suspend your use of Famipics, in whole or in part, or close your account, without prior notice, where:

Where we can, we tell you why. Closing an account has the same effect as deleting it (section 9): your phones are disconnected and your memberships end. Where a closure leaves a family holding more than the free plan allows, its photos and videos are handled as section 6 sets out for the end of a subscription.

11. Changes to Famipics, and to these terms

We improve Famipics continually and may change or remove features. If we ever had to stop the service, we would give at least 60 days' notice in the app and by email. During that period every family could select its photos and videos in the app and save them to its own phones. We may update these terms; material changes are announced in the app before they apply, and continuing to use Famipics after that date means you accept them.

12. What we promise, and what we do not

We work to keep Famipics available, accurate and safe, but we provide it as it is: we do not promise that it will be free of interruptions or errors, and we depend on the stores, on our providers and on your own phone and connection. Your photos are stored with care, but Famipics is not a backup service: keep copies of what matters to you.

To the extent the law allows, our liability to you for any claim arising from Famipics is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect losses. Nothing in these terms limits our liability for damage caused by our intent or gross negligence, or any liability that cannot be limited under the Consumer Contract Act of Japan or other applicable law.

13. Law and disputes

These terms are governed by the laws of Japan. Any dispute arising from them or from Famipics is subject to the exclusive jurisdiction of the Tokyo District Court in the first instance. This does not deprive you of the protection of mandatory consumer law in your country of residence.

14. Language

These terms are written in English, which is the governing text. The Japanese and French versions are translations provided for convenience; if they differ, the English text prevails.
